Title: My rights?
My husband told me last night he is moving out today after work. Married 17 years - what property can he take today? I use the computer for my job, but know that he will want to take it. He is already leaving me without a vehicle, I need advice. Thanks

I'm not sure that a restraining order will meet your needs. You need to speak to an attorney asap. Property division is one of the most difficult steps of the process and must be decided upon by both parties. He is not "entitled" to any joint property (anything purchased/invested in during the marriage). I am a Certified Financial Divorce Planner and deal with this issue frequently. Get a lawyer immediately, whether you think he's just moving out or will actually go proceed with a divorce. You need to be aware of your legal rights. You also need to speak to a divorce financial planner to assess the marital and separate property. Divorce is as much a financial separation as it is a legal and emotional one. Feel free to call or email me should you have any questions or need advice.

he cannot claim marital property Is he divorcing or just moving out you both should have property rights that's my opinion I would get the court to put a restraining order out.
