Divorce in Quebec.
I was married for 20 years, successful business owner. Two grown up children. During our life together (with my wife, I mean) we acquired investment properties, which I put on my wife’s name; the reason, being business owner, I was able to be perused for taxes, etc. this way the properties were safe!!! Year 2000, I had a heart attack, which left me with 37% heart capacity, and unable to operate the business longer. I sold the business, gave some of the proceeds to my wife to keep in the safety deposit box (in her name only also) and concentrated in maintaining and managing the properties. Shortly after, my wife decided to “cash” on the marriage, and we started divorce procedures, which are still not finalized. In the interim, the revenue properties were given by the court (Quebec, Canada) for management to her, and immediately, there was no income whatsoever declared (net, net, net income of over $30,000 from the revenue properties was declared the last year before the court decision). My questions are: 1. Am I entitle to a portion of the revenue from the income property (not matrimonial house), 2. Where I can find a case decisions (Superior Court of Quebec, unfortunately here in Quebec we are : “Everybody is backward, we are sidewise” our laws are specific!!!) to support my claim for the portion of the revenue, 3. As I am not able to work anymore, am I entitle to a financial support, and if where to look for similar Court Decisions (Superior Court of Quebec), 4.
