Title: Can a separaton agreement override a Divorce agreement
In the 2001 separaton agreement it identifies pension funds to be paid out to spouse at the time of retirement. However, in the divorce order no mention of pension and no mention of separation agreement terms were referred to in the single paragraph granting the agreed to divorce. Given this in any circumstances could the separation agreement terms still be pursued or upheld?
